Successful Defense in Multi-Vehicle Collision Trial

Case Summary: DJS Associates, Inc. was retained to provide expert analysis in a complex three-vehicle collision that occurred when a vehicle attempted a left turn out of a parking lot, threading between a line of stopped traffic.  As it entered the roadway, it was struck by another vehicle that was traveling with the right of way.  The impact deflected the left-turning vehicle into a third car, occupied by Plaintiff, which was stopped in the traffic queue.

Our client, the driver traveling on the roadway (Co-Defendant), faced allegations of speeding.  Plaintiff’s counsel argued that excessive speed contributed to the severity of the crash.

Expert Analysis: Through a detailed review of physical evidence, the collision reconstruction engineers of DJS Associates, Inc. identified that the airbags in Co-Defendant’s vehicle did not deploy during the collision.  This finding, along with a supporting crush and momentum analysis, contradicted the claim of high-speed travel and supported the conclusion that Co-Defendant was operating at a reasonable speed under the circumstances.

Result: The case went to trial, where DJS Associates, Inc. rendered testimony that clearly explained the mechanics of the crash, the lack of support for a speeding allegation, and the sequence of vehicle interactions. The jury ultimately found Co-Defendant to be 0% at fault, assigning 100% liability to the left-turning vehicle.
